Terms of Use

These Website Terms of Use (“Terms”) govern access to and use of https://montanepm.com, https://support.montanepm.com, and the pages, portals, forms, features, content, and services made available through those websites (collectively, the “Websites”), operated by Montane Packaging, LLC (“Montane,” “we,” “us,” or “our”).
By accessing or using either of the Websites, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Websites.
Use of the Websites is also governed by Montane’s Privacy Policy, available on the Websites, which is incorporated into these Terms by reference.
1. Website Use
The Websites are provided for informational and business purposes, including providing information concerning Montane’s packaging machinery, equipment, services, applications, and capabilities; facilitating communications with Montane; providing customer support; providing access to technical documentation and manuals; and allowing customers and other authorized users to submit and track service, support, and spare-parts requests.
The Websites are intended for business use by individuals who are at least 18 years of age. You may use the Websites only for lawful purposes and in accordance with these Terms. You may not:
- Use the Websites in violation of applicable law;
- Attempt to gain unauthorized access to the Websites, user accounts, restricted documentation, servers, networks, databases, or related systems;
- Interfere with or attempt to interfere with the operation, security, or availability of the Websites;
- Introduce malicious code, viruses, automated attacks, or other harmful material;
- Scrape, crawl, harvest, or systematically collect information from the Websites without Montane’s prior written authorization;
- Circumvent or attempt to circumvent authentication, access restrictions, document-viewing restrictions, or other security measures;
- Use another person’s credentials or permit an unauthorized person to use credentials issued to you;
- Use the Websites to infringe or violate the rights of Montane or any third party; or
- Use information or materials obtained through the Websites for any unlawful, competitive, or unauthorized commercial purpose.
2. Support Portal Accounts and Access
Certain portions of support.montanepm.com may be available only to customers, employees of customers, or other users authorized by Montane. Where an account or other authentication credentials are required, you are responsible for maintaining the confidentiality and security of your credentials and for activity occurring through your account.
You may not share your account or credentials with persons who are not authorized to access the applicable materials. You agree to promptly notify Montane if you become aware of unauthorized access to your account, loss or compromise of credentials, or other suspected security issues.
Montane may establish, modify, restrict, suspend, or terminate access to the support portal or particular materials at any time, including when Montane reasonably believes that an account has been misused, compromised, or accessed by an unauthorized person. Access to the support portal does not create any ownership interest in the portal, its software, its documentation, or any materials made available through it.
3. Manuals and Restricted Documentation
The support portal may provide authorized users with access to equipment manuals, drawings, specifications, service documentation, technical information, training materials, and other proprietary materials (“Support Materials”). Unless otherwise expressly stated in writing, Support Materials are made available solely for the internal business use of the customer or organization to which access has been granted and solely in connection with the operation, maintenance, servicing, evaluation, or use of applicable Montane equipment.
Subject to these Terms, Montane grants authorized users a limited, non-exclusive, non-transferable, revocable right to access and use Support Materials for those purposes. You may not, except with Montane’s prior written authorization or where expressly permitted through the applicable Website functionality:
- Distribute or provide Support Materials to unauthorized persons;
- Publish Support Materials publicly;
- Sell, sublicense, or commercially exploit Support Materials;
- Remove copyright, confidentiality, proprietary, or other notices;
- Circumvent restrictions intended to prevent unauthorized downloading, copying, or distribution; or
- Use Support Materials to reproduce, reverse engineer, manufacture, or develop equipment or products in violation of Montane’s intellectual-property or contractual rights.
Availability of a manual or other Support Material through the support portal does not supersede equipment-specific instructions, safety notices, service bulletins, written agreements, or later revisions provided by Montane.
4. Website Content
Montane makes reasonable efforts to maintain accurate information on the Websites. However, Website content may contain errors or omissions and may be modified, corrected, supplemented, or removed at any time without notice.
Product descriptions, photographs, illustrations, specifications, dimensions, capacities, operating speeds, configurations, availability, technical materials, and other information presented on the Websites are provided for general informational purposes unless expressly identified otherwise. Website content does not constitute a final engineering specification, warranty, guarantee of performance, offer for sale, or binding contractual commitment unless expressly stated otherwise in a written agreement executed by Montane.
Actual equipment configuration and performance may vary depending upon product characteristics, packaging materials, operating conditions, equipment configuration, maintenance, environmental conditions, and other application-specific factors.
5. Quotations and Requests
Submission of a request for information, quotation, consultation, or other communication through the Websites does not create a contract or otherwise obligate Montane to provide products or services. Montane may request additional information concerning the customer’s application, products, facility, operating conditions, equipment requirements, or other relevant matters before preparing a quotation or proposal.
All quotations and proposals issued by Montane are subject to the terms, conditions, specifications, validity periods, and other provisions stated therein. A binding agreement for the purchase of equipment or services shall arise only upon execution or acceptance of the applicable written agreement, quotation, purchase order, sales agreement, or other document governing the transaction.
6. Support Tickets and Service Requests
The support portal may allow users to report equipment issues, request technical assistance, request spare parts, submit service-related information, and track existing requests. Submission of a support ticket or other request does not guarantee a particular response time, resolution, availability of parts, eligibility for warranty coverage, or availability of service.
Use of the support portal does not create or expand any warranty, maintenance obligation, service-level commitment, or other contractual obligation beyond those expressly provided in a separate written agreement between Montane and the applicable customer. Montane may request additional information, photographs, videos, equipment information, serial numbers, operating details, samples, or other materials reasonably necessary to evaluate or respond to a request.
Users are responsible for providing accurate information and for following appropriate workplace, equipment, electrical, mechanical, lockout/tagout, and other safety procedures when inspecting, operating, troubleshooting, maintaining, or servicing equipment. If instructions provided through a support communication conflict with an applicable equipment manual, safety notice, written service bulletin, or instruction provided directly by authorized Montane personnel, contact Montane before proceeding.
7. Pricing
Unless expressly stated otherwise, prices or pricing information appearing on the Websites are not binding offers. Pricing may vary based upon equipment configuration, options, ancillary equipment, engineering requirements, installation requirements, shipping, taxes, duties, parts availability, and other factors. Montane reserves the right to correct pricing or other errors and to modify pricing at any time without notice.
8. Text Messaging
Where an individual provides a mobile telephone number and consents to receive text messages from Montane, Montane may send text messages concerning the scheduling of appointments, service, support, order updates, and related business matters.
Message frequency varies. Message and data rates may apply. Individuals may opt out at any time by replying STOP and may reply HELP for assistance. Carriers are not liable for delayed or undelivered messages. The collection, use, and protection of mobile telephone numbers and text-messaging opt-in data are described in Montane’s Privacy Policy.
9. Intellectual Property
All content appearing on the Websites, including without limitation text, photographs, graphics, illustrations, videos, product images, logos, trademarks, trade names, designs, layouts, manuals, technical documentation, drawings, downloadable materials, software interfaces, and other materials, is owned by Montane or used by Montane under authorization and is protected by applicable intellectual-property laws.
Except as expressly permitted by these Terms, by applicable law, or in a separate written agreement with Montane, no portion of the Websites or their content may be reproduced, distributed, modified, transmitted, displayed, published, licensed, sold, or otherwise exploited without Montane’s prior written consent.
Materials made publicly available through montanepm.com may be accessed, downloaded, and printed for legitimate internal business evaluation and informational purposes, provided that proprietary, copyright, trademark, and other notices are not removed. Restricted Support Materials available through support.montanepm.com are subject to the additional restrictions described in Section 3.
10. Trademarks
Montane Packaging Machinery, Montane, and all related names, logos, marks, and product names displayed on the Websites are the property of Montane or their respective owners and may be protected by trademark or other applicable law. No right or license to use any trademark or other proprietary mark is granted by these Terms.
11. User Submissions
Information submitted through the Websites may include contact information, quotation requests, support tickets, equipment information, descriptions of technical issues, photographs, videos, documents, attachments, emails, and other communications or materials (“User Submissions”). You represent that:
- Information you submit is accurate to the best of your knowledge;
- You have authority to provide the submitted information and materials; and
- Your submission and Montane’s use of it for the purposes described in these Terms and the Privacy Policy will not violate applicable law or the rights of any third party.
You retain any ownership rights you may have in User Submissions. You grant Montane and its service providers, suppliers, manufacturers, contractors, and business partners the right to access, reproduce, transmit, review, and otherwise use User Submissions as reasonably necessary to respond to your request, diagnose equipment or application issues, provide products or services, maintain business records, protect Montane’s systems and legal rights, and otherwise conduct the applicable business relationship.
Personal information contained in User Submissions will be handled in accordance with Montane’s Privacy Policy. You should not submit passwords, payment-card information, highly sensitive personal information, or other information unrelated to the applicable business or support request through free-text fields or file uploads.
12. Third-Party Websites and Services
The Websites may contain links to or use functionality provided by third-party websites, platforms, software, or services. Montane provides third-party links and integrations for convenience or business functionality and does not control third-party websites or their content except where expressly stated. Montane is not responsible for the availability, accuracy, security, content, privacy practices, or terms of independent third-party websites or services.
13. No Professional or Engineering Advice
Information contained on the Websites, including information provided through support materials and general support resources, does not constitute independent engineering, safety, regulatory, legal, or other professional advice.
Website information does not replace application-specific engineering analysis, testing, validation, risk assessment, installation requirements, operating procedures, maintenance procedures, employee training, or applicable regulatory requirements. Customers and users are responsible for determining the suitability of equipment and procedures for their particular application and operating environment and for complying with applicable workplace and equipment-safety requirements. Final equipment specifications and application requirements must be confirmed with Montane before purchase.
14. Availability and Errors
Montane may modify, suspend, discontinue, or restrict access to all or any portion of the Websites, including the support portal, accounts, documentation, ticketing features, and other services, at any time. Montane does not warrant or represent that the Websites will be continuously available, uninterrupted, error-free, secure, or free from viruses or other harmful components. Montane does not warrant that all Website content, Support Materials, ticket information, or other information will remain current or complete.
15. Suspension or Termination of Access
Montane may suspend or terminate a user’s access to restricted portions of the Websites if Montane reasonably believes that the user has violated these Terms, compromised Website security, misused restricted information, ceased to be authorized by the applicable customer organization, or otherwise presents a security, legal, or operational risk. Sections of these Terms that by their nature should survive termination shall remain effective after access is terminated.
16. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITES AND ALL CONTENT, MATERIALS, INFORMATION, SUPPORT FEATURES, AND SERVICES MADE AVAILABLE THROUGH THE WEBSITES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONTANE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
NOTHING IN THIS SECTION LIMITS OR DISCLAIMS ANY WARRANTY OR OBLIGATION THAT CANNOT LAWFULLY BE LIMITED OR DISCLAIMED. ANY WARRANTIES APPLICABLE TO EQUIPMENT, PARTS, OR SERVICES PURCHASED FROM MONTANE ARE GOVERNED SOLELY BY THE EXPRESS WRITTEN WARRANTY OR OTHER AGREEMENT APPLICABLE TO SUCH EQUIPMENT, PARTS, OR SERVICES.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MONTANE PACKAGING, LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF OR RELATING TO:
- ACCESS TO OR USE OF THE WEBSITES;
- INABILITY TO ACCESS OR USE THE WEBSITES;
- RELIANCE UPON WEBSITE CONTENT OR SUPPORT MATERIALS;
- ERRORS OR OMISSIONS IN WEBSITE CONTENT OR SUPPORT MATERIALS;
- UNAUTHORIZED ACCESS TO OR USE OF AN ACCOUNT;
- LOSS, INTERRUPTION, DELAY, OR FAILURE OF THE SUPPORT PORTAL OR TICKETING SYSTEM; OR
- ANY OTHER INTERRUPTION, FAILURE, OR LOSS ARISING FROM THE WEBSITES OR THEIR OPERATION.
THIS SECTION DOES NOT APPLY TO LIABILITY ARISING UNDER A SEPARATE WRITTEN AGREEMENT FOR THE PURCHASE OF EQUIPMENT, PARTS, OR SERVICES, WHICH IS GOVERNED SOLELY BY THAT AGREEMENT. NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
18. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Montane Packaging, LLC and its members, managers, officers, employees, agents, affiliates, contractors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- Your violation of these Terms;
- Your unlawful or unauthorized use of the Websites;
- Your unauthorized disclosure or use of restricted Support Materials;
- Your violation of applicable law or regulation; or
- Your infringement or violation of the rights of any third party.
19. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-law principles. To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms or your use of the Websites shall be brought in a state or federal court located in Utah County, Utah, and you consent to the jurisdiction and venue of such courts.
20. Modifications
Montane reserves the right to modify these Terms at any time. Revised Terms shall become effective upon posting to the Websites unless otherwise stated. Your continued use of the Websites following the posting of revised Terms constitutes your acceptance of the revised Terms.
21. Severability; Waiver
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall remain in full force and effect. Montane’s failure to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other provision, and no waiver shall be effective unless made in writing by Montane.
22. Entire Agreement
These Terms, together with the Privacy Policy, constitute the agreement between you and Montane concerning your use of the Websites and supersede prior or contemporaneous understandings concerning such use, except to the extent that separate written agreements expressly govern products or services purchased from Montane.
Nothing in these Terms modifies or replaces any written quotation, purchase agreement, sales agreement, warranty, service agreement, confidentiality agreement, or other contract between Montane and a customer. If a separate written agreement between Montane and a customer conflicts with these Terms regarding the purchase, operation, maintenance, or servicing of equipment, the separate written agreement controls with respect to that subject matter.
